Açıkhava Fabrikası Medya Reklamcılık Hizmetleri A.Ş. ("Outdoor Factory" or the "Company"), acting as data controller under Law No. 6698 on the Protection of Personal Data ("KVKK"), processes the personal data of individuals who visit www.outdoorfactory.com (the "Site") or who contact the Company through the Site or by e-mail. This Information Notice is prepared pursuant to Article 10 of the KVKK and the Communiqué on the Procedures and Principles to be Followed in Fulfilment of the Obligation to Inform, in order to inform you about the processing of your personal data. This Notice should be read together with the Site's Privacy Policy and Cookie Policy, which supplement the provisions set out below.

2. Categories of Personal Data Processed and Purposes of Processing

The following categories of personal data are processed through the Site:

Outdoor Factory does not aim to collect special categories of personal data (such as data concerning race, ethnic origin, or health) within the meaning of Article 6 of the KVKK through the Site. Should any such data be shared with us unintentionally, it will not be used for any purpose other than the original request and will be protected through appropriate technical and administrative measures.

 

3. Purposes of Processing

Your personal data referred to above may be processed for the following purposes:
● Operating, administering, and improving the Site,
● Analyzing Site performance and measuring traffic,
● Responding to your inquiries and managing commercial communications,
● Improving user experience,
● Maintaining Site and information security,
● Preventing fraud or misuse,
● Complying with obligations under applicable law.

 

4. Method of Collection and Legal Basis

Method of Collection: Your personal data is collected electronically — automatically, through cookies and similar technologies and log records, when you visit the Site; and directly from you when you complete the contact form or otherwise contact us by email.

Your personal data is processed on the following legal grounds set out in Article 5 of the KVKK:
● For essential cookies and technical data necessary to operate the Site and the contact form: processing is directly related to the establishment or performance of a contract, and is necessary for the Company to comply with its legal obligations (KVKK Art. 5/2(c) and 5/2(ç));
● For identity and contact data you provide through the contact form or by email in order to have your inquiry answered: processing is necessary for the legitimate interests of the Company, provided that this does not harm your fundamental rights and freedoms (KVKK Art. 5/2(f));
● For analytics and marketing cookies (such as Google Analytics, Meta Pixel, and LinkedIn Insight Tag): your explicit consent (KVKK Art. 5/1). This data is processed solely on the basis of the explicit consent you provide through the cookie consent banner — not on the basis of legitimate interest or any other ground — and you may withdraw your consent at any time.

 

5. Transfer of Personal Data

5.1 Domestic Transfers
Subject to the conditions set out in Article 8 of the KVKK, and limited to the purposes described in this Notice, your personal data may be transferred to:
● Authorized service providers acting on the Company's behalf,
● IT infrastructure, hosting, and analytics providers,
● Legal, financial, and audit advisers,
● Competent public authorities and judicial bodies, where legally required.

 

5.2 International Transfers

Certain third-party services used on the Site (such as Google, Meta, and LinkedIn) may process personal data on servers located outside Türkiye. Such transfers are carried out in accordance with Article 9 of the KVKK, as amended by Law No. 7499, and the Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad dated 10 July 2024, relying — in order of priority — on:
● An adequacy decision issued by the Turkish Personal Data Protection Board ("Board") with respect to the relevant country, sector, or international organization (KVKK Art. 9/1–3);
● In the absence of an adequacy decision, appropriate safeguards, such as a Board-notified Standard Contract, binding corporate rules, or a written undertaking approved by the Board (KVKK Art. 9/4);
● Only where neither of the above is available, and exclusively for occasional (non-systematic) transfers, your explicit consent given after being informed of the possible risks of the transfer (KVKK Art. 9/6).

Because transfers arising from the use of analytics and marketing tools are systematic in nature, such transfers primarily rely on the appropriate-safeguards mechanism - in particular, Standard Contracts executed with the relevant providers and notified to the Board. The explicit consent given through the cookie consent banner remains a separate requirement for the placement of non-essential cookies on your device and is not, on its own, the legal basis for the resulting international transfer. For visitors located in the European Economic Area, transfers are additionally carried out in accordance with Chapter V of the GDPR.

 

6. Your Rights

Under Article 11 of the KVKK, you may apply to the Company to exercise the following rights:
● To learn whether your personal data is being processed,
● To request information regarding the processing of your personal data,
● To learn the purpose of processing and whether your data is used in accordance with that purpose,
● To know the third parties to whom your personal data is transferred, in Türkiye or abroad,
● To request correction of incomplete or inaccurate personal data,
● To request deletion or destruction of your personal data within the framework of Article 7 of the KVKK,
● To request that any correction, deletion, or destruction be notified to third parties to whom the data has been transferred,
● To object to a result to your detriment arising from the analysis of your data exclusively through automated systems,
● To claim compensation for damages arising from the unlawful processing of your personal data.

If you are located in the European Economic Area, you additionally have the rights of access, rectification, erasure, restriction of processing, objection, withdrawal of consent, and data portability under the GDPR, and the right to lodge a complaint with your local supervisory authority.

 

7. How to Exercise Your Rights

You may submit requests concerning the rights set out above, in accordance with the Communiqué on the Principles and Procedures of

Application to the Data Controller:
● in writing, to our registered address set out above,
● via our KEP (registered electronic mail) address, or
● by email to info@outdoorfactory.com, sent from an email address previously notified to us and on record with the Company, together with information verifying your identity. Your request will be concluded free of charge, as soon as possible and, in any event, within thirty (30) days at the latest. If your request is rejected, if the response is found inadequate, or if no response is received within the statutory period, you may lodge a complaint with the Turkish Personal Data Protection Board.

 

8. Cookies

For further information on the cookies used on the Site, and on how your consent for non-essential (analytics and marketing) cookies is obtained, may be changed, and may be withdrawn, please refer to our Cookie Policy.

 

9. Updates

This Information Notice may be updated to reflect changes in applicable law or in the Site's data processing activities. The latest version, together with its effective date, will always be available on the Site.
